The Fruity Frostings mobile message service, referred to as the "Service," is managed by Fruity Frostings (“Fruity Frostings,” “we,” or “us”). Utilizing the Service implies your consent to adhere to these terms and conditions, herein referred to as “Mobile Terms.” We reserve the right to alter or discontinue the Service or its features without prior notice. To the extent permitted by applicable law, we retain the authority to amend these Mobile Terms at our discretion. Your ongoing use of the Service after the effective date of such modifications shall signify your acknowledgment and acceptance of said changes.
By granting consent to Fruity Frostings' SMS/text messaging service, you consent to receive periodic SMS/text messages from Fruity Frostings and its representatives sent via your wireless provider to the mobile number you supplied. We may continue to contact you even if your mobile number is registered on any state or federal Do Not Call list. Our text messages may be dispatched using an automated telephone dialing system or similar technology. Messages related to the service may encompass updates, notifications, and information (such as order updates and account alerts). Promotional messages may include offers, promotions, and other marketing communications (such as shopping cart/browse reminders).
You understand you are not obligated to enroll in this program to make any purchases from Fruity Frostings. Your consent is not a requirement for any transactions with us. Your decision to participate in this program is optional.
Our Service is free; however, you are accountable for any fees related to text messaging set by your wireless provider. The frequency of messages may vary, and message and data rates may apply. Please review your mobile plan and contact your wireless provider for specific information. You are responsible for covering all SMS/text message expenses, including those incurred through your wireless provider.
Cancellation
You have the right to opt out of the Service at your discretion. Simply send the command "STOP" via text or utilize the unsubscribe link (if provided) in any text message to unsubscribe. You may also use the following keywords: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to cancel. Following your request, you will receive a confirmation text message confirming your opt-out, and no additional messages will be sent to your mobile device unless you initiate the contact or have subscribed to other Fruity Frostings mobile message programs and wish to terminate them. However, in situations where applicable law necessitates otherwise, you must independently opt out of those programs by adhering to the instructions outlined in their respective mobile terms.

We reserve the right to modify any shortcode or telephone number used for the Service at our discretion and will notify you of any such changes. Please be aware that messages, including STOP or HELP requests, sent to an altered shortcode or telephone number may not be received. We shall not be held accountable for fulfilling requests conveyed through such messages.
The wireless carriers facilitating the Service bear no responsibility for messages that may experience delays or fail to deliver. It is your responsibility to furnish us with a valid mobile number. If you acquire a new mobile number, you must re-enroll in the program using your updated number.
To the extent allowed by relevant law, you consent to our immunity from liability in cases of information sent through the Service that experiences failed, delayed, or misdirected delivery, any inaccuracies within said information, and any decisions or actions you make, or refrain from making, based on the information or the Service.
We uphold your privacy rights. Please refer to our Privacy Policy to review our procedures for collecting and utilizing your personal information.
Modifications and Product Availability
Fruity Frostings can make changes to our product offerings due to seasonality or other operational reasons. On occasion, the item that selected may no longer be available after it is ordered. Should this occur, the customer will receive an email to select a different item that is currently available.
In the event that the customer is unable to enjoy the product due to any unknown dietary restrictions or preferences, the customer will receive an email crediting the items purchased and to select a product that better fits their taste buds. All of our products have an ingredients list posted on the website and a label on bottom of the packaging.
Subscription Terms of Service
6 months of a Fruity Frostings Subscription
By purchasing 6 months, you acknowledge that your subscription has an initial pre-payment feature for 6 months of service. At the end of the 6 months, your subscription will be automatically extended for another 6-month term at the then-current subscription rate. You may only cancel your 6-month subscription during the first month of the subscription. To cancel your subscription, you can email us at subscriptions@fruityfrostings.com. Fruity Frostings may submit periodic charges (e.g., semi-annually) without further authorization from you until you provide prior notice that you have terminated this authorization or wish to change your payment method. Such notice will not affect charges submitted before Fruity Frostings reasonably could act. If a subscription product arrives damaged due to weather or other issues that occur during shipping, we will replace the order on the next available ship date at no charge.
3 months of a Fruity Frostings Subscription
By purchasing 3 months, you acknowledge that your subscription has an initial pre-payment feature for 3 months of service. At the end of the 3 months, your subscription will be automatically extended for another 3-month term at the then-current subscription rate. You may only cancel your 3-month subscription during the first month of the subscription. To cancel your subscription, you can email us at subscriptions@fruityfrostings.com. Fruity Frostings may submit periodic charges (e.g., quarterly) without further authorization from you, until you provide prior notice that you have terminated this authorization or wish to change your payment method. Such notice will not affect charges submitted before Fruity Frostings reasonably could act. If a subscription product arrives damaged due to weather or other issues that occur during shipping, we will replace the order on the next available ship date at no charge.
Fruity Frostings Month-to-Month Subscription
By purchasing a Fruity Frostings Month-to-Month Subscription, you acknowledge that your subscription has an initial and recurring monthly payment feature and accept responsibility for all recurring charges before cancellation. Your subscription will be automatically extended for successive monthly periods, at the then-current subscription rate. To cancel your Monthly Subscription at any time, you can email subscriptions@fruityfrostings.com and we will cancel your renewal for you. If you cancel, you may use your subscription until the end of your then-current subscription term. Fruity Frostings may submit periodic charges (e.g., monthly) without further authorization from you until you provide prior notice that you have terminated this authorization or wish to change your payment method. Such notice will not affect charges submitted before Fruity Frostings reasonably could act.
Fruity Frostings Weekly Subscription
By purchasing a Fruity Frostings Weekly Subscription, you acknowledge that your subscription has an initial and recurring weekly payment feature and accept responsibility for all recurring charges before cancellation. Your subscription will be automatically extended for successive weekly periods, at the then-current subscription rate. To cancel your Weekly Subscription at any time, you can email subscriptions@fruityfrostings.com and we will cancel your renewal for you. If you cancel, you may use your subscription until the end of your then-current subscription term. Fruity Frostings may submit periodic charges (e.g., weekly) without further authorization from you until you provide prior notice that you have terminated this authorization or wish to change your payment method. Such notice will not affect charges submitted before Fruity Frostings reasonably could act.
If a subscription product arrives damaged due to weather or other issues that may occur during shipping, we will re-ship a replacement order at the next available ship date at no charge. We reserve the right to revoke your subscription at any time as a result of a violation of these Terms or the Privacy Policy. Membership is void where prohibited by law.
